Draft Claim Farming Practices Prohibition Bill 2025 (NSW)

The ALA has been authorised to publish our submission to the NSW Government’s Department of Communities and Justice (DCJ) regarding the draft of the Claim Farming Practices Prohibition Bill 2025 (NSW) (Draft Bill).
Our submission reiterates the ALA’s strong and long-standing opposition to claim farming, including our members‘ concerns that claim farming practices affect some of the most vulnerable people in NSW, especially those who have been injured and those who are victim survivors of abuse.
In relation to the provisions of the Draft Bill, the ALA has made recommendations about parts of the Draft Bill that require clarification in order to ensure that pathways to justice for victim survivors and the legitimate provision of legal services are not adversely impacted. The recommendations in our submission focus on the:
- language used in the Draft Bill;
- intended scope and impact of provisions regarding referrals;
- application of the Draft Bill’s proposed provisions; and
- interaction with Commonwealth laws.
