Aged Care Rules 2025

The ALA provided feedback to the Department of Health and Aged Care ('Department') on the Consultation Draft of the Aged Care Rules 2025 ('Rules').
The ALA's submission analyses the version of the Rules released in April 2025 (known as "Release 4b") as part of the Department's consultation on the Rules, including with reference to broader aged care legislative reform.
Our submission addresses the Rules regarding the:
- obligations on registered aged care providers and the rights provided for aged care residents, including the rights and recourse for an injured aged care resident;
- delivery of funded aged care services;
- requirement for service agreements;
- care and service plans; and
- complaints and resolution of complaints, including the ALA's proposed additional mandatory clauses to the residential aged care contract.
Once finalised, the Rules are intended to provide further instruction on how the Aged Care Act 2024 (Cth) operates.
The Department released the final draft of the Rules on 31 July 2025. These Rules will guide the operation of the Aged Care Act 2024 (Cth). The Department also published a summary of the key changes to the Rules.
Following the release of the final exposure draft of the Aged Care Rules 2025, the Department have provided a roadmap to assist providers in preparing for the new Aged Care Act.
The new Aged Care Act will come into force 1 November 2025.
