Legal Profession (Strengthening Disciplinary Matters) Amendment Bill 2026

The ALA has provided a submission to the Queensland Parliament’s Justice, Integrity and Community Safety Committee’s (Committee) inquiry into the Legal Profession (Strengthening Disciplinary Matters) Amendment Bill 2026.
The ALA supports the Bill, particularly in relation to the transferring of serious disciplinary matters involving findings of professional misconduct, suspension or removal from the roll to the Supreme Court, as this better reflects the gravity and quasi-criminal effect of those determinations.
The ALA also welcomed the Bill’s codification of the Pennisi costs approach, its strengthened statement-of-reasons and appeal pathways, and the retention of both lay and practitioner participation in disciplinary decision-making.
The Committee has published its report for it’s inquiry into the Legal Profession (Strengthening Disciplinary Matters) Amendment Bill 2026. The Committee recommended that the Bill be passed.
The Bill would transfer legal practitioner disciplinary jurisdiction and other related matters from the Queensland Civil and Administrative Tribunal to the Supreme Court. It would also clarify the procedural and costs arrangements applying to these proceedings.
