Inquiry into the Guardianship and Administration System in Western Australia

The ALA has made a submission to the Community Development and Justice Standing Committee Inquiry into the Guardianship and Administration System in Western Australia.
In its submission, the ALA emphasised the importance of ensuring that guardianship and administration arrangements operate efficiently, transparently and in the interests of represented persons. Drawing on members’ experience acting in personal injury claims, the ALA highlighted concerns about resourcing pressures, delays, administrative inefficiencies and the potential impact of those issues on access to justice, legal costs and timely resolution of claims.
Further, the ALA recommended strengthening the capacity and staffing resources of the Public Trustee, the Office of the Public Advocate and the State Administrative Tribunal. The submission also called for more efficient briefing and information management practices, clearer complaint and review pathways, and improved communication with represented persons and their families.
