Flight delays: why are Australian passenger rights so far behind?

The post pandemic travel recovery has seen chaos for air passengers. June 2022 saw the worst domestic on time performance on record, and this remains poor. A delayed Sydney to Melbourne passenger would think they’re dreaming if they were automatically given $370 compensation for a three-hour delay, but that is the law for equivalent flights in the European Union.

Travel lawyer Victoria Roy explores the limited remedies for delayed flight passengers under the Australian Consumer Law compared to the enhanced consumer remedies in other jurisdictions, and argues that it is time that Australia catches up.
