Overview
This year’s WorkCover seminar will look at recent lawsuits involving psychological injuries and compensation claims in a workplace. Hear barrister Susan Anderson address the key takeaways in Ackers v Cairns Regional Council [2021] QSC 342 and the unsuccessful attempt by the defendant to apply Paige v New South Wales [2002] 60 NSWLR 371 to a performance management process. The session will cover the requirement of the provision of support to workers found in Hayes v State of Queensland [2017] 1 Qd R 337 and New South Wales v Skinner [2022] NSWCA 9.
Solicitor/Associate, Peter Adams, will present a case review on Kozarov v State of Victoria [2022] HCA 12 and in particular the circumstances whereby the risk of psychiatric injury in the workplace is obvious, or foreseeable, regardless of indicia displayed by the plaintiff.
