Alternative diversion model for children under the raised minimum age of criminal responsibility

SOUTH AUSTRALIA

The ALA has been authorised to publish the submission we made last month to the SA Attorney-General's Department regarding its consultation on the proposed alternative diversion model for children under the raised minimum age of criminal responsibility.

The premise of this consultation is that the Government of South Australia is considering raising the minimum age of criminal responsibility to 12 years. The ALA is concerned by this premise and our submission reflects the ALA’s support for raising the minimum age of criminal responsibility to 14 years without exceptions.

In our submission, the ALA also provides analysis on the proposed alternative diversion model – including identifying the ALA’s concern that there is minimal reference to and no detail in the consultation materials on specific processes and resources for supporting Aboriginal and Torres Strait Islander children, who are currently disproportionately represented in the criminal justice system.
