Communications Legislation Amendment (Combatting Misinformation and Disinformation) Bill 2024 (Cth)

The ALA has made a submission to the Environment and Communications Legislation Committee regarding the Communications Legislation Amendment (Combatting Misinformation and Disinformation) Bill 2024 (Cth) (Bill).

Our submission addresses the following matters:

  • Freedom of expression considerations – with regards to the proposed triennial reviews of this legislation, as well as the urgent need for a federal Human Rights Act;
  • Clarifying criteria, qualifiers and threshold terminology used in the Bill; and
  • Administrative review of decisions made by the Australian Communications and Media Authority, in particular urging the Federal Government to ensure the Administrative Appeals Tribunal (soon to be Administrative Review Tribunal) is sufficiently resourced to address this additional demand.

The ALA made a submission to the Department of Infrastructure, Transport, Regional Development, Communications and the Arts in August 2023 on the Exposure Draft of this legislation.
