Inquiry into the potential for a Human Rights Act for South Australia

SOUTH AUSTRALIA

The ALA recently made a submission to the Parliament of South Australia’s Social Development Committee (‘Committee’) as part of the Committee’s inquiry into the potential for a Human Rights Act for South Australia.

The ALA contends that a legislative human rights instrument in South Australia is an important and essential reform for the State, a reform which has consistently attracted popular support and which would be compatible with other initiatives from the Parliament of South Australia – for example, the formation of the South Australian First Nations Voice to Parliament.

Our submission addresses:

  • the case for adopting a Human Rights Act in South Australia, with reference to the operation and effectiveness of human rights legislation in other jurisdictions;
  • what should be included in a future Human Rights Act in South Australia; and
  • the potential implications of a Human Rights Act in South Australia for the making of laws, courts, tribunals, public authorities and other entities.
