Review of the Counter-Terrorism and Other Legislation Amendment Bill 2023 (Cth)

The ALA made a submission to the Parliamentary Joint Committee on Intelligence and Security regarding the Review of the Counter-Terrorism and Other Legislation Amendment Bill 2023. Our submission opposes amending the Crimes Act 1914 (Cth) to extend the operation of police powers in relation to terrorism for a further three years until 7 December 2026. Such provisions continue the operation of warrantless searches, and allow control orders and preventative detention orders. We submit that there should be no place for such powers in a liberal democracy such as Australia.

Rather, we advocate for a federal Human Rights Act which would ensure that those who wield power within Australia’s federal institutions are subject to a code of conduct, in accordance with the rule of law.
